An attempt by Acision Nederland B.V. to have Anam’s European patent EP 1683375 relating to their Smart Services Messaging technology revoked, failed in a recent hearing before an Opposition Division of the European Patent Office.
The Opposition Division heard extensive arguments from both Acision Nederland B.V. and from Anam, who were represented by Dr Christina Gates and Dr Seán Harte of Tomkins & Co. After considering the arguments advanced by both sides the Opposition Division maintained the patent in a slightly amended form, which does not substantively change the scope of protection afforded by the patent.
This decision means that Anam’s European patent, EP 1683375 remains in force alongside U.S. patent US 800549 and their corresponding patents in other countries.
Following the decision Anam’s CEO Gerry Mc Kenna commented,“We are delighted that the decision to maintain our patent has been upheld.
