Irvine, CA, United States, 2010/05/14 - Scilabs Nutraceuticals, Inc. filed suit against Naturade Operating Corp. and NNC, LLC (case #00341089), who operate under the brand name Naturade®, for breach of contract, fraud, and the misappropriation of trade secrets.
Contract manufacturer Scilabs Nutraceuticals, Inc. headquartered in Irvine, California, filed suit against Naturade Operating Corp. and NNC LLC, who operate under the brand name Naturade®, for breach of contract, fraud, and the misappropriation of trade secrets. The suit, case number 00341089, was filed in Orange County Superior Court, Santa Ana.
Despite recent negative and false statements from Naturade CEO Rick Robinette, seeking to deter Scilabs from recovering its damages, Scilabs intends to continue pursuing its multi-million dollar suit.
Robinette states that Naturade moved production in an “…opportunity to reformulate and improve all [their] products”. However, Scilabs always produced high quality products for Naturade. For example, in 2009, Naturade’s product, Weight Gain, won a Vity® Award from industry publication Vitamin Retailer. As detailed in the suit, Robinette even acknowledged Scilabs’ contribution to the achievement of this award when asked if it was a product Scilabs had formulated.
The contention that Scilabs uses low quality ingredients, or attempts to cut corners, could not be further from the truth. Scilabs uses only the highest quality ingredients sourced from some of the top vendors in the industry, whose reputations are widely known, including Mainstreet Ingredients, Stauber Performance Ingredients, Norben Company, and Virginia Dare.“ Attacks against our reputation will not be tolerated,” states Paul Edalat, CEO of Scilabs.

It’s unfortunate that in cases such as this, reverse engineering by one party is wrongfully misappropriating the intellectual property of another”, Edalat states. “But we are confident that clever marketing can no longer trick informed consumers into buying compromised products.”
Edalat further goes on to re-state Scilabs’ position that the merits of the suit will be proven as more evidence comes to light. “One can only hide behind their lawyers for so long. Our formulas are being produced at other labs, without our consent. Just exactly where, is what our investigators are discovering. Scilabs will seek recovery for all its legal remedies against any responsible manufacturer and lab, as well.”
